Nature of the service

diff.site is an online service (SaaS) for visual and functional comparison of websites, offered as a monthly or annual subscription.

Intellectual property

All content on the diff.site website (text, images, graphics, logo, icons, software) is the exclusive property of Italic or its partners and is protected by French and international intellectual property laws. Any reproduction, representation, modification, or adaptation, in whole or in part, is prohibited without prior written authorization.

Data controller

The data controller is Italic, the studio publishing this site. Germain Metti is the contact point for data protection matters, reachable through the contact form.

Purposes and legal bases

We process personal data for the following purposes:

• Creating and managing your account (email address, name) — performance of the contract.
• Billing and subscription management — performance of the contract and statutory accounting obligations.
• Answering messages sent through the contact or support forms — legitimate interest in responding to enquiries.
• Anonymous audience measurement — legitimate interest, under the consent exemption defined by the French data protection authority (CNIL).
• Protecting public forms against automated submissions — legitimate interest in the security of the service.

Content analysed by the service

The service captures the pages of the websites you point it at. Those captures may contain personal data present on the analysed pages. For that content you remain the data controller and Italic acts as a processor, on your instructions only. We recommend not submitting pages containing sensitive data to the service.

Retention periods

• Account data: kept for as long as the account is active, then deleted when the account is closed.
• Captures, runs and comparisons: purged automatically according to your plan — 1 day for the public demo, 7 days on the Free plan, 90 days on Solo, 365 days on Pro, and without limit on the Agency and Enterprise plans.
• Invoices and accounting records: 10 years, as required by French commercial law.
• Support messages: kept for as long as needed to handle the request, then archived in the support mailbox.
• Audience measurement: browsing data, already anonymised on collection, is deleted automatically after 14 months; only aggregated statistics are kept beyond that.

Recipients and processors

Your data is never sold or transferred. It is accessible to the following providers, strictly within the scope of their assignment:

• Scaleway (France) — server and data hosting.
• Stripe (Ireland / United States) — payment processing. No card details pass through or are stored on our servers.
• Mandrill, a service of Intuit Mailchimp (United States) — delivery of transactional emails and contact messages.
• Google reCAPTCHA (United States) — bot protection on the public contact form, loaded only once you start filling it in.
• Matomo — audience measurement, self-hosted on our own servers in France; no data is passed to a third party.

Transfers outside the European Union

Stripe, Intuit Mailchimp and Google may process some data in the United States. These transfers are governed by the European Commission's standard contractual clauses and, where applicable, by those providers' certification under the EU-U.S. Data Privacy Framework.

Your rights

You have the right to access, rectify, erase, restrict, object to and port your data. Account holders can export all of their data and delete their account directly from their account settings. For any other request, write to us through the contact form.

If, after contacting us, you believe your rights have not been respected, you may lodge a complaint with the CNIL (www.cnil.fr).

Cookies and audience measurement

No advertising cookie is set and no profiling is carried out.

• The service only uses technical storage needed to operate: an authentication token, the session for access to a password-protected share, and your language preference. These are exempt from consent.
• Audience measurement uses Matomo, self-hosted and configured without cookies, with IP anonymisation. It therefore falls under the consent exemption recommended by the CNIL and needs no banner.
• One exception: on the contact page, Google reCAPTCHA may set cookies. It is loaded only when you start filling in the form; merely browsing the site sets nothing.

Objecting to audience measurement

Subscription terms

Access to the service is offered as a monthly or annual subscription. Prices are listed in euros including tax on the Pricing page.

Renewal is automatic. You can cancel at any time from your account settings. Cancellation takes effect at the end of the current billing period.

In accordance with article L221-28 of the French Consumer Code, the right of withdrawal does not apply to services fully performed before the end of the withdrawal period and whose execution began with the consumer's agreement.

Limitation of liability

Italic strives to ensure service availability but cannot guarantee uninterrupted operation. Italic shall not be held liable for any direct or indirect damages resulting from the use or inability to use the service.

Applicable law

These legal notices are governed by French law. In the event of a dispute, French courts shall have exclusive jurisdiction.
